Yesterday, the Ravensburg district court dismissed the lawsuit of a man whose father died after his corona vaccination. The son of the deceased had sued for damages: he accused the vaccinating doctor of not having sufficiently informed his father about the vaccination and its risks. The plaintiff’s attorney noted that this is likely to be the case for 95 percent of those vaccinated in Germany. He sees a political judgment here.
The plaintiff’s father, who was 87 at the time, had been vaccinated against Corona by a general practitioner in Bad Schussenried (Biberach district) in June and July 2021 and again in January 2022. He died eight months after his third vaccination. The son of the deceased sees a connection between vaccinations and death: He accuses the doctor of not having sufficiently informed his father about the vaccination and possible consequences. He therefore regards the consent given by his father as invalid. As his father’s heir, the plaintiff demanded compensation for pain and suffering in the amount of 22,500 euros, i.e. 7,500 euros per vaccination.
The Ravensburg Regional Court sees no entitlement to compensation for pain and suffering and dismissed the lawsuit on the grounds that the son had not mentioned any specific health problems affecting his father as a result of the vaccinations, not even swelling and tension in the area of the injection site in the days after the respective vaccination Vaccination. Even if there was no effective consent from the patient, no monetary compensation was required just for the prick with the needle and the introduction of the vaccine, the court argued in the reasoning published on Thursday. The verdict is not yet legally binding.
“Political Judgment” – 95 percent of vaccinates insufficiently informed
From the point of view of the plaintiff’s lawyer, Eberhard Frohnecke from Osnabrück, this is a political judgment, because claims for compensation for pain and suffering can already be asserted if the vaccination doctor has only provided incorrect information. The lawyer’s explanation: For the patient, every treatment is an intrusion into the physical integrity. In the case of a vaccination with a needle, even from a legal point of view a dangerous physical injury. Exacerbated by the administration of a suspected undertested vaccine. “This is equivalent to poisoning in the legal sense,” explains Frohnecke. For this reason, the patient must consent to the procedure “of their own free will, without fear and without pressure” on the basis of a full declaration explaining the pros and cons of the corona vaccination, as well as the urgency, risks, possible consequences and also the chances of success. “If this does not happen, then the education is ineffective – and there is a claim for damages.” According to Frohnecke, 95 percent of those vaccinated against Covid in Germany were not sufficiently informed.
Apart from that, it is generally difficult to claim vaccine damages. Those affected by heart problems, brain dysfunction and neurological diseases have the best chance of compensation. Some insured persons suffer from an increased tendency to bleed, scars on the vaccination arm, incontinence, paralysis or embolism. Deaths as a result of the vaccination – for example after cerebral vein thrombosis – have been recognized in isolated cases. The vaccine manufacturers are in the clear, because all EU governments have contractually agreed to pay for all claims for damages. In the case of particularly severe vaccination damage, those affected can receive benefits under the Infection Protection Act.
Lawyer overrun by victims of vaccinations
Although the chances of success are slim, some vaccine victims go to court. Attorney Frohnecke is working at full capacity. “Currently, no further mandates can be accepted,” he said on his website. The demand is high: “Every day I get ten to 15 new inquiries, including serious cases,” he explained in Ravensburg.
Nevertheless, vaccination damage is being put into perspective and even the vaccination narrative is still being maintained, again by the Secretary General of the German Society for Immunology. “Every single case of vaccine damage is of course sad, but you have to put it in perspective. Almost 65 million people were vaccinated in Germany,” he told the Süddeutsche Zeitung. While some have had more serious side effects, the vaccines have saved millions of people from serious illnesses – and tens of thousands from death, according to the unsubstantiated claim. As long as this narrative continues to be defended, victims of vaccine injuries and families of victims will continue to have a very difficult time in court.
