The German Federal Administrative Court has now determined that the Bavarian state government must reimburse unjustly collected corona fines. It is about all the cases where people left their homes at the beginning of the alleged pandemic to be outdoors. Prime Minister Markus Söder, who his critics called a totalitarian turnaround, had these people pursued and punished by the police.
A few thousand Bavarians, who were unjustly treated by officials and punished at the time, can now informally reclaim these fines from the responsible authorities. The Federal Administrative Court in Leipzig had already determined at the end of November 2022 that the exit restrictions in Bavaria were disproportionate and therefore ineffective.
The all-day, and thus also during the daytime, ban on leaving one’s own apartment to stay outdoors was a serious encroachment on the basic rights of the addressees.
Justification of the administrative judges
In Bavaria, they wanted to wait for the written version of the verdict, which has since happened. Now the repayments are carried out “as unbureaucratically as possible”. The exact number of those affected would be unclear – T-Online writes of up to 22,000 possible cases in the period from April 1 to 19, 2020. The exact text of the judgment would be interesting, but our editors have not been able to find it so far.
