On February 26, 2022 in Vienna-Landstraße, a man (25) hit a person (59) for long-term care without any comprehensible reason. After a dispute broke out between the two, the attacker hit his opponent with one punch in the face. The victim fell to the ground and suffered a fractured skull with cerebral hemorrhage and traumatic brain injury as a result of the impact. The perpetrator was convicted on Monday of assault with serious permanent consequences.
A panel of judges at the regional court imposed an unconditional prison sentence of four and a half years on the three-times convict. The victim was awarded compensation of almost 19,000 euros. After consulting defender Wolfgang Mekis, the man accepted the penalty. The public prosecutor also agreed, so the verdict is final.
The accused was on his way to the supermarket with his mother and his girlfriend when his companions were approached and annoyed by the man. “I was so in love with my girlfriend at the time,” the young man told the court. Due to the abusive remarks of the completely unknown, visibly drunk man, he “had such a stress”.
Later investigations showed that the victim had 2.3 per mil in the blood at that time. The defendant assured that he had not “full hit”. He just pushed the man away with his fist. If I had hit him really hard, more would have happened.” “Any more?” interjected the judge, “he can no longer come here and testify.”
