After the specific case of the kitchen consultant, the vaccination cards of his colleagues were also checked. Amazingly, they had identical vaccine batches on their passports. The background to the dispute was the entry into force of the 3G rule in the workplace on November 24, 2021, which states that employees must be vaccinated or recovered or have a negative test.
The day before the rule was enforced, the plaintiff had indicated that he did not wish to be vaccinated. Just one day later, he presented the employer with a copy of his vaccination certificate, which showed a double vaccination against the corona virus. The attentive employer confronted the employee with the similarity of the vaccination batches in his ID card to those of a colleague, after which the latter admitted the falsification. The immediate result was termination of his employment without notice.
