Perhaps you still remember our open letter to the regulatory authority KommAustria, with which we reported misconduct by the ORF in the Corona reporting. Such an ad required the support of 120 GIS fee payers – we submitted over 300. But because the GIS numbers and handwritten signatures were missing, the ad was now rejected.
The resistant regional broadcaster RTV from Steyr was also interested in the facts and produced the following “talk” on the subject:
On January 20, Florian Machl, representing report24, addressed an open letter to the ORF and asked the readership for support. This exceeded the legally required number of supporters by more than twice.
Bureaucratic hurdles and alleged formal errors
After the open letter had been reported to the regulatory authority, we received brief feedback: We had not attached an adequate list of supporters, supporters would have to be given a GIS number. In our opinion, this was not true, we have uploaded the list with the software provided by the office. We asked about the legal basis for this harassment, since the GIS numbers would undoubtedly have emerged from the transmitted name and address data. There was no further clarification – until finally our complaint was rejected due to formal errors.
The justification now states that the formal requirements of §36 ORF-G, paragraph 2 would not have been fulfilled. This reads:
(2) The support of a complaint pursuant to paragraph 1 no. 1 lit. b must be proven by a list of signatures from which the identity of the persons supporting the complaint can be determined.
In our opinion, there was no need to list the GIS numbers from this paragraph. In the justification for the rejection it is therefore noted that there is an explanation of the law in which a more precise reading can be found. (Kogler/Traimer/Truppe Österreichische Rundfunkgesetze 340).
We are not giving up: the project is entering the second round
One can now argue whether the identity could have been ascertained from it – In any case, we will not give up and will not let the ORF get away with what we believe to be intentional and health-endangering false reporting. All of our previous supporters will receive a form from us in which they can enter their GIS number as well as their previous data and sign it themselves. If the system demands it, we’ll just play along – as a result, the law will also have to deal with the content of the complaint.
