Lawyer Michael Schilchegger describes the problem of the long duration of proceedings before the VFGH. For example, a decision as to whether mandatory vaccination violates the constitution could last into next year.
If a citizen wants to be sure that the vaccination does not harm them physically, they can go to the authorities for a long time – and thus also postpone the vaccination obligation for them individually. After all, nobody can deny you individual medical advice and a precise clarification of the risks. You can ask the authorities reasonable and legitimate questions and refer to your own medical history.
You can find out whether you are allergic to active ingredients and should consult various doctors. Because, according to Schilchegger, a dermatologist can only define whether the vaccination is problematic for the skin, for other questions you might need other specialists. If you proceed correctly and explain to the authorities why this clarification is necessary, criminal liability for refusal to vaccinate cannot be completely prevented, but it can be postponed into the distant future.
Mandatory vaccination law could also simply expire
The law itself is initially only valid for two years – at the latest then there are national elections. The politician and legal expert doubts whether a government would extend such a controversial law in the election year.
