A young Serb was sentenced on Wednesday at the Regional Court for Criminal Matters to 19 years in prison for the robbery and murder of a Viennese jeweler, whom he stabbed to death on October 14, 2020 in his shop on Landstraßer Hauptstrasse, and for four other brutal robberies. The young Serb, whom the chairman described as a “serious criminal” in the judgment, escaped the maximum sentence. The judgment is not final.
According to the Juvenile Court Act (JGG) – the defendant was still 20 years old at the time of the offense and should therefore be regarded as a young adult – up to 20 years would have been possible. When determining the penalty, the cruel approach, the large number of facts and the high damage were added to aggravate the problem. The man’s previous innocence and above all his contribution to the establishment of the truth were mitigating. After his arrest in Hungary and the subsequent extradition, in addition to the five robbery facts, he admitted 51 burglaries committed in the federal capital. Above all, however, he named his accomplice in the attack on the jeweler and an opera singer whom the two had attacked in his apartment 18 hours before the bloody act. The accomplice – also a native Serb – is now being searched internationally. Another person involved in the other crimes has already been arrested.
The 21-year-old made a shaken impression after the verdict was announced. After consulting with defense attorney Martin Mahrer, he asked for time to think about it.
In the jewelry store in Vienna-Landstrasse, the 21-year-old armed with a knife – the accomplice was standing outside Schmiere – initially pretended to be a customer. He bought a ring for 68 euros and subsequently pretended to be interested in a necklace. When the jeweler presented him with several necklaces to choose from, the young man pulled out a knife and stabbed.
Two of a total of 19 stitches were fatal on their own, said forensic doctor Nikolaus Klupp on the second day of the trial – the defendant had confessed to being responsible at the start of the trial last Monday. One opened the chest cavity, the second damaged the lungs. According to Klupp, the 74-year-old man would have had no chance of survival, even with rapid emergency medical help.
After the 21-year-old had left for the Czech Republic with his accomplice and stolen gold jewelry, ducats and several watches, passers-by found the stabbed jeweler in the entrance area. Just hours earlier, the two criminals broke into an opera singer’s apartment. The 56-year-old artist was deep asleep in his bed when he was brutally awakened by the intruders at 4:30 a.m.
“I woke up because I was hit several times on the forehead,” the singer now described as a witness to the court. A man grabbed his neck with one hand and hit him with a crowbar with the other. “I tried to fight back. I served in Russia for two years, ”said the 56-year-old, referring to his military training at the time.
But then his voice helped him. In order to clearly show the jury’s effect, he imitated the screams that he yelled “straight into the ear” of one of the two perpetrators, as the 56-year-old emphasized. The “Help, Police!” could have been heard as far as the Josefstadt prison bordering the court, especially since negotiations were held with the windows open due to Corona. “I didn’t stop screaming. With that I scared them, ”reported the witness. The criminals would have left the apartment without prey.
The attack had drastic consequences for the singer. He can no longer pursue his job. A blow with the crowbar caused a complicated injury to the left eye – the person concerned has since suffered from severe visual impairment. “I’ve learned to live with it,” he said.
