The lawyers Mag. Höllwarth and Mag. Scheer already appeared in the fight against ordinances and laws in the context of the G-rules. Now they are mobilizing in a new initiative on a broad front against the mandatory vaccination planned in Austria from February 1, 2022.
They presented their new project in a press conference on November 26th, 2021 Platform to prevent compulsory vaccination before, in addition to the previous initiative www.covid-beschwerde.at stands. The lawyers emphasize that the law of compulsory vaccination will not only apply to those people who do not want to have the Covid vaccination administered. It also includes those who have recovered, regardless of their immunization. And it will also affect people who have already been vaccinated because they are forced to regularly booster vaccinations. Höllwarth and Scheer take the view that “medical treatments are something very personal and individual” that cannot be “lumped together” by law. All citizens can therefore be partners on their platform.

On the website can be read as follows (emphasis and subtitles by the editor):
An unprecedented attempt
“On November 19, 2021, the Federal Chancellor of the Republic of Austria and the ministers of the Federal Government announced in a press conference that he was planning to introduce mandatory vaccination for everyone across Austria from February 1, 2022 – by law.
This announcement is an unprecedented attempt by a federal government into the fundamental rights of citizens and residents of the country, which are guaranteed to all of us by the state constitution, the federal constitution, the EU treaty and the European human rights convention, to intervene.
Already on the day after the announcement certainly did Over 100,000 people demonstrated against this planned measure in Vienna alone. Regardless of their personal political opinion or political orientation, many Austrians recognize that the planned compulsory vaccination would represent a serious violation of their rights. This awareness in the population of basic rights and the lack of understanding in their interference can be found in vaccinated, recovered and unvaccinated people. “
Neither corona deniers nor vaccination opponents
The two lawyers see themselves neither as “corona deniers”, nor as “vaccination opponents”. They write down that they are the Vaccination against Covid-19 for a possible, However not the only way to fight the pandemic keep. With their commitment against the compulsory vaccination they have the protection of human rights in the sense of the European Convention for the Protection of Human Rights and Fundamental Freedoms ECHR and the constitutional provisions in focus, with the right to personal physical integrity in the foreground. They believe that nobody should be forced to have a vaccination. The free decision of the individual not to be vaccinated must not lead to any disadvantages compared to those who claim the vaccination.
No forced treatment
Höllwarth and Scheer maintain that none of the previous vaccines provides the permanent sterile immunity promised by politicians. The view that vaccination is a “game changer” is scientifically less and less tenable. However, the problem of severe disease progression in fully vaccinated people (vaccination breakthroughs) is becoming increasingly greater:
“In our opinion, the most important tool for breaking the chain of infection is comprehensive testing (using a PCR test), as well as the timely establishment of a sufficient medical infrastructure system through which the few people who are actually seriously ill with SARS-CoV-2 can be treated appropriately. Political failure must not lead to the violation of fundamental rights. In addition, the decision about medical treatment is a fundamental right in our Western European value system, as there was general consensus since the 1950s, that one does not have to tolerate compulsory treatment when other options are open. “
With your initiative that has now been launched Platform to prevent compulsory vaccination they are interested in taking legal action against any mandatory vaccination law, on the one hand in the run-up to the legislative process and on the other hand after the law has been passed in the form of legislative proposals to the Constitutional Court, the European Court of Human Rights and possibly other courts of justice. “
Concrete steps are planned:
“Man’s freedom does not lie in the fact that he can do what he wants, but in the fact that he does not have to do what he does not want.”
