The third President of the National Council, Norbert Hofer, then sued the angry citizen for insult. Hofer was right by the first court, but the higher regional court ruled against him. Based on the decision, the court ruled that it could not be deduced that Hofer belonged to a “brown rascals”, but anti-corona demo participants – whom the citizen described as a “fool’s seam”. According to the court, this formulation is to be regarded as admissible political criticism.
