Bayern Munich defender Lucas Hernández don’t have to go to jail. The Spanish judiciary upheld the appeal of the 25-year-old French’s lawyers on Wednesday just before the deadline for entering custody. The six-month prison sentence for domestic violence had already been imposed in 2019. According to the Madrid court, she was suspended for four years.
The background to the case is a tangible dispute from Hernández with his girlfriend at the time and now wife, which happened four and a half years ago – in February 2017 – when the French national soccer player was still involved with Atletico Madrid. Both were subsequently sentenced to community service and a six-month ban on contact for domestic violence.
Since the two quickly reconciled, they went away Hernández and his partner together during the ban on contact, with which the 2018 world champion violated the ban. A contact ban remains in place in Spain even if there has been a reconciliation so that no one can be compelled to undertake such a reconciliation.
The new ruling comes as a surprise – not only because the fight against domestic violence is taken very seriously in Spain. The majority of experts had expected that the appeal would be rejected because Hernández is not a so-called first-time offender. According to the judiciary, there are a total of two final convictions for domestic violence against the professional soccer player.
